The Executive Office for Immigration Review (EOIR) published a proposed rule on procedures that affect the Board of Immigration Appeals (BIA) and immigration judges’ authority to manage their dockets. NIPNLG submitted a comment that largely supported the rule, particularly aspects of the rule that rescind Trump-era anti-immigrant provisions. We urge EOIR to go further in clarifying the rights of noncitizens to have their cases adjudicated before EOIR when they want them adjudicated, expanding noncitizens’ rights in motions to reopen, and in ensuring that legal practitioners have ample time to litigate appeals.
