In February 2023, the Biden Administration issued a proposed rule which would ban most asylum seekers who cross unlawfully into the United States from obtaining asylum. Modeled after a Trump-era rule the “Circumvention of Lawful Pathways” (CLP) Rule, restricts asylum to those who enter the United States lawfully or with a CBP One appointment. As a result, most asylum seekers will be subjected to a higher screening standard at the border, with the hope of winning withholding of removal, a permanent limbo status with no pathway to citizenship. NIPNLG strongly submitted a comment strongly opposing this rule which violates U.S. and international law and harms marginalized asylum seekers, including Indigenous people.
