National Immigration Project Welcomes SCOTUS Ruling Allowing Biden Administration to Terminate 'Remain in Mexico' Policy

Washington, DC -  Today the U.S. Supreme Court ruled in Biden v. Texas that the Biden administration acted within its legal authority when it terminated the Trump-era so-called Migrant Protection Protocols (MPP), or Remain in Mexico policy. The case, brought by the states of Texas and Missouri, challenged the Biden administration's formal termination of the callous policy last summer.

As the Biden v. Texas case has proceeded through the courts, the National Immigration Project and its partners at the Center for Gender and Refugee Studies, Innovation Law Lab, the Southern Poverty Law Center, and Arnold and Porter continue to litigate a separate case, Immigrant Defenders Law Center et al. v. Mayorkas, which challenges harms suffered by asylum seekers who remain stranded outside the United States due to the effects of the policy's first incarnation under the Trump administration.

"Today's Supreme Court decision affirms the Biden administration's responsibility to terminate the destructive Remain in Mexico policy. This is a victory for thousands who were left stranded in dangerous conditions while exercising their right to seek asylum - but even this critical win is not enough. The Remain in Mexico policy forced tens of thousands of people into precarious and life threatening situations with no recourse. The government cannot shut its eyes to the inhumanity and suffering it has manufactured. Along with terminating the policy immediately, the Biden administration must also ensure that every single individual harmed through this policy has a meaningful opportunity to pursue their asylum claims from within the United States.''
