On November 19, 20205, DHS and USCIS issued a Notice of Proposed Rulemaking to rescind the 2022 public charge regulations, leaving USCIS officers with unfettered discretion to determine who meets the requirements. The National Immigration Project strongly opposes this recession of a well-reasoned rule, finalized after public comment, and expressed deep concern that the public charge changes will lead to family separations, and limit lawful immigration to only the wealthiest noncitizens.
