On June 18, 2026, the National Immigration Project, Central American Legal Assistance, and Center for Gender and Refugee Studies filed an amicus brief in the Second Circuit Court of Appeals, arguing that family group membership clearly meets the criteria for particular social group in asylum law. Family has been recognized as the prototypical grouping in human society and decades of precedent have recognized this. We call on the Second Circuit to overturn the Board of Immigration Appeals’ precedent severely restricting family-based asylum.
