The National Immigration Project and University of Pennsylvania Transnational Legal Clinic filed an amicus brief on behalf of Human Rights First in a Second Circuit Petition for Review. The case is a direct challenge of last year’s BIA precedent, Matter of L-T-A-, 29 I&N Dec. 362 (BIA 2025), which expanded the firm resettlement bar to asylum to include applicants who have not received an offer of permanent status, but are merely allowed to remain in a third country without status. Our brief argues that this interpretation is contrary to U.S. law, international law, and will lead to thousands of asylum seekers being unjustly returned to their country of feared harm.
