Mendez Rojas v. Kelly: One-Year Asylum Deadline
This lawsuit challenges the government’s failure to provide noncitizens with adequate notice of the one-year filing deadline for asylum applications, and seeks to establish a uniform mechanism that ensures they have an opportunity to timely file their applications. In January 2017, a federal court granted nationwide class action status in the case, which was filed on behalf of thousands of asylum seekers pursuing protection for persecution in their countries of origin.
The case was filed as a nationwide class action in the U.S. District Court for the Western District of Washington by NIPNLG, Dobrin & Han, PC, the Northwest Immigrant Rights Project, and the American Immigration Council.
