American Immigration Council v. DHS: Policies on Expedited Removal of Families
NIPNLG, the ACLU, and the American Immigration Council filed a Freedom of Information Act (FOIA) request with DHS and its component agencies for records related to the use of expedited removal—a summary form of deportation that generally provides no opportunity for a hearing before an immigration judge—against families, including those then detained in Artesia, New Mexico. After the agencies failed to respond to the request, NIPNLG, the ACLU, the American Immigration Council, the National Immigration Law Center and Jenner & Block LLP filed a FOIA lawsuit in the U.S. District Court for the Southern District of New York. In response to the litigation, DHS and its component agencies have released thousands of pages of records.
