D- v. Holder : Mandamus to Compel Adjudication of BIA Appeal
This lawsuit was filed on behalf of a U.S. citizen improperly placed in removal proceedings by DHS, challenging the BIA’s failure to adjudicate the administrative appeal of his removal order for over three years. NIPNLG filed the case in the U.S. District Court for the District of Connecticut. Shortly thereafter, the BIA issued a decision in the underlying administrative appeal, recognizing that the plaintiff in this case had met his burden of proving his U.S. citizenship and terminating removal proceedings against him.
