[Redacted] v. CBP: Expedited Removal after Fundamentally Unfair Deportation
This lawsuit challenged an expedited removal order entered against a former long-time lawful permanent resident and asylum seeker who previously had been ordered removed improperly due to ineffective assistance of counsel. After she attempted to reenter to the United States, CBP issued an expedited removal order, even though a federal court had dismissed the criminal charge of illegal reentry against her, finding that initial removal order had been fundamentally unfair. The case was filed in the U.S. District Court for the District of Vermont by NIPNLG and the Federal Defenders Office. The plaintiff voluntarily dismissed the case after DHS agreed to vacate the expedited removal order.
