Program Description: ICE has deported many people who have strong legal claims to reopening their removal orders. These individuals, if successful on a motion to reopen, could become eligible to legally return to the United States. Often, such "post-departure" claims are predicated on procedural or substantive errors in removal proceedings, subsequent legal developments, and/or post-conviction relief. Additionally, some cases present significant humanitarian concerns that may warrant reopening and return to the United States. However, even if a person prevails on a post-departure motion, it is often difficult to secure their return. This webinar will discuss post-departure motions to reopen and options for obtaining return after prevailing on a motion to reopen. The speakers will also discuss the role of parole, prosecutorial discretion requests for deported individuals, and visa and waiver applications.
